Preambule The terms and conditions of sales are contracted by the two following parts: the first part is the company Emoluxe SARL (denominated Emoluxe in the following texts) and the second part concerns any person or company that would like to purchase our products, through the website of Emoluxe ( www.emoluxe.com), denominated “Customers” in the following lines. The confirmation of the product’s order displayed on the website of Emoluxe implies your express agreement of the following terms and conditions of sales, without the need of your hand-writing signature.

FRANCE Article 1: Products and Prices 1.1. Products
The products that are offered are those which appear in the catalog published in the website www.emoluxe.com. The products and services are offered according to the stock’s availability. Each product is accompanied by its formal description. The pictures in the catalog are as faithful as possible, but they can not provide a perfect likeness of the product offered, especially concerning the colours. 1.2. Fees and Taxes
The prices of our products are mentioned in Euros, all taxes included. However, they do not include the fees concerning the treatment and the shipping of the goods. The amount of these additional fees will appear when you will confirm your order. (Please check the conditions of shipping). The orders shipped inside the European Union will be subjected to 19.6 % French VAT tax, which is already included in the displayed prices. When the destination of shipping is outside the European Union, the tax will be automatically deducted before you make payment online. Overseas customers do not pay French VAT (at 19.6%). However, when your parcel arrives, you will be asked to pay your country's import tax. This varies from one country to another and is approx. 8% of the total order for the United States of America. Article 2: Registration and confirmation of an order 2.1. Order
The customer who would like to purchase a product has to enter the required information for the treatment of his order. It is extremely simple to take an order on the website of Emoluxe. After selecting the products, the customer will be able at any time:
- To get a summary of the products that he selected, by the click of the button “Shopping Cart”.
- To continue his selection of products by the click of the button “Continue Shopping”.
- To end up the selection of his products and order his products by the click of the button “Checkout”. To order the products that he chose, after clicking on the button “Checkout”, each customer should identify himself, either by tipping his email and password, if he is already a client of Emoluxe, or if it is not the case, by completing an application form. In this last hypothesis, the customer will have to complete precisely the application form which will be at his disposal. The application form will contain notably the required information to identify him, and notably, his name, his first name, his address, his phone number, and his email address. The customer is informed and accepts that those two personal information (email address and password) are considered as a proof of his identity and reveal his agreement. As soon as the customer is identified, he will have to confirm the address of delivery, and then an order form will appear on the screen, it will sum up: nature and price of the products selected by the customer, and also the total amount of the order, his personal information, and the address of delivery of the products. 2.2. Confirmation of the order
After checking the state of his order, and that all the required information are completed by the customer, he will have to click on the button “validate”, to confirm definitely his order and follow the next step: the payment of the order. The customer will be able to pay by credit card or by bank check, (cf: art 2.3). 2.3. The requirement for a secure payment
2.3.1. By credit card :
To ensure a secure transaction, the payment will be made by the secure bank services of our partner bank “Caisse d’Epargne”. That implies that your bank information would not pass through our website.
The payment with a credit card is then perfectly secure; your order will be registered and validated as soon as the payment is accepted by your bank. The bank details are encrypted thanks to the protocol of SSL (Secure Socket Layer) and never transit uncoded through the network. The payment is directly executed by the bank “Caisse d’Epargne”. Emoluxe has no access to those bank details under any circumstances, and do not keep them on its servers. 2.3.2. By French bank check :
Only checks issued by a Bank domiciled in France are accepted. Your order is reserved for 7 days. But, after that delay, if we do not receive your bank check, your order will be cancelled. The order will be processed only after the reception of your check, and the confirmation. 2.3.3. By transfer payment :
Concerning the important orders and also for the professional, you can use the transfer payment. In that case, please contact us, and we will let you know the requirements. 2.4. The confirmation of the order
According to the law of the 13th of March 2000, about the electronic signature, and the law of the 21st of June 2004, about the trust of the numeric economy, every order validated by the client by a “double click” is considered as an irrevocable agreement concerning the general conditions, by the client, replacing a hand-writing signature, and can not be contested.
Emoluxe will send by email the confirmation of the registered order; this confirmation will sum up notably, all the elements of the order. However, the orders are not permanent, and the send of the order will be executed as soon as we receive the payment concerning bank check and transfer, and as soon as the amount is debited from the account of the customers, concerning the payment by credit card.
Emoluxe keeps the possibility to choose whether the confirmation is possible or not, for any reasons, notably for an unusual order or a possible problem concerning the shipping. Emoluxe is attached to inform the customer with any ways, which are in its disposal.
2.5. Availability of the products
Every enamel’s creation provided by the gallery Emoluxe is unique. If an article is not available, you will receive an email that will allow you to cancel or modify your order. Article 3. Shipping 3.1. Shipping We prepare your order and transfer it to our shipping services as soon as your payment is received and validated. Every product return must result from an agreement between the customer and Emoluxe.
The shipping's services take a particular care of the packaging of the products in order to reduce the risk of breakage. When the customer will receive the goods, he must absolutely check the state of the products, and its conformity, in respect to the order.
In the case where the package is damaged, the purchaser must refuse it, and must make it certify by the carrier (the post or chronopost), or if he does not follow the procedure, no claims would be receivable.
According to the article L.121-20 and the followings of the consumption code, you dispose of a delay of 7 working days, from the date of shipping of your order, to return every article that are not convenient, in its original packaging, and in a good state, proper to its commercialization, and ask for the exchange or the reimbursement without any penalty fees, except concerning the return fees. You dispose of 7 days to report that you would like to retract yourself, and so, the customer service will give you a number of agreement for a return. Do not forget that the product should be returned with its certificate of authenticity. Article 4. Intellectual ownership All the elements of the website http://emoluxe.com are and stay the exclusive and intellectual ownership of company Emoluxe SARL. Nobody is allow to reproduce, exploit, diffuse, or use, even partially, some elements of the website, whether they are software, visual aid, or sonorous. Every simple links or hyperlinks, are purely prohibited, without an express written agreement from Emoluxe. Article 5. Data and confidentiality The company Emoluxe SARL is attached to respect the confidentiality of the data concerning its customers, and will not provide them to someone else. The “cookies” are used in the website, but only to remember the contain of a shopping cart, when you add some articles and to allow you to come back to your shopping cart or your wedding list of an ulterior date.
